Eight men have been jailed after a British teenager was filmed being gang-raped at a hotel in Magaluf. The men admitted wrongdoing in eleventh-hour plea deals with prosecutors today, reducing their total jail time from more than 150 years to just over 73 for the “repugnant” crimes. Public prosecutors initially said they were seeking sentences of between 18 and 20 years for each of the accused, seven French nationals and one from Sweden, as they laid bare the sickening and degrading treatment the 18-year-old was subjected to in room 108 of the BH Mallorca Resort on August 14, 2023.
On the first morning of what was due to be a four-day public hearing at the Audiencia Provincial Court in Palma, however, it was confirmed that the men had agreed to plead guilty in exchange for reduced sentences. The five men who penetrated their victim accepted jail terms of nine to 11 years for sexual assault, with three receiving the higher prison sentences because they repeated their crimes. The three men who didn’t penetrate the holidaymaker but filmed the sex attacks committed by others were handed prison sentences of two years and three months.

The men are expected to be deported to their home countries once they have served part of their time behind bars, although the decision on exactly how long they stay in prison will be decided sometime next month.
Well-placed sources said they believed they could be kicked out of Spain after doing six or seven years’ jail time, though public prosecutors could try to convince judges that they should serve their full sentences.
One of the trio received an additional four-year prison sentence for sexually assaulting the holidaymaker without penetrating her as part of the plea bargain confirmed in court today. The three were the only ones granted bail around nine months before the start of today’s trial.
The British teenager, whose defence lawyer Irene Hernandez works for respected Spanish law firm Campaner Law, was previously told that she didn’t need to appear in person or via video conference at the men’s trial, with the witness statement she had already given under oath during the judicial investigation deemed sufficient.
She is understood to have admitted to cops that she had no real recollection of the multiple sex attacks she was subjected to because she was barely conscious after drinking heavily.
Both the public prosecutor and the holidaymaker’s lawyer had to agree to the punishments meted out to the men who targeted her as part of their plea bargain deals.
The sickening footage recorded by the men, who came from different groups and didn’t all know each other before they targeted their victim, proved key in the arrests and subsequent prosection.
One well-placed insider said: “The room where the sexual assaults took place was occupied by two friends, but they didn’t know the others involved. It was almost a case of them opening the door and inviting others passing by in the corridor to join in.
“If the men hadn’t filmed what they’d done, they could have got off scot-free.”
Another said: “These men appear on the surface to be regular young guys who don’t come from broken families and have never tried to allege they were acting out of character by trying to link what they did to the abuse of alcohol or drugs. It’s such a shocking case.”
Two of the suspects, charged following a lengthy probe by an investigating magistrate, were held abroad on a European Arrest Warrant and extradited. Six were detained in Majorca.
Some of the harrowing details about the actions of the men accused of the sickening crimes, committed from around 7.30am on August 14, 2023, had already emerged by the time they were charged.
Reports at the time said three of the suspects met the teenager hours earlier while partying in Magaluf and one had allegedy gone out into a hotel corridor after “sexually attacking” her to encourage strangers returning from their own nights out to have “free sex” with her.
The 14-page indictment laying out the case against the suspects confirmed many aspects of those reports, saying six of the suspects went to room 108 at the resort and met another two men who were already inside with the teenager.
It said: “There, the accused men, during approximately half an hour, aware of the semi-conscious state the young woman was in and at one point seeing she had fallen into a state of unconsciousness … stripped her naked, leaving her with only her bra on.
“They then carried out different sexual acts on her, acting by common consent and without her consent.”
The indictment also said she was raped in all manner of ways, spat on, “hit and smacked on her bottom”, and described how she was surrounded by the “libidinous” gang as they shouted insults at her while perpetrating their sex crimes.
It went on to accuse two of the men of sharing recordings from their phones on Snapchat while their victim was still “semi-unconscious or unconscious”. One of the suspects was accused of filming 14 videos lasting 170 seconds, and another of filming five videos lasting 142 seconds.
The eight men were in their late teens and early twenties when they were arrested. The charges laid as part of the criminal investigation included five counts of rape involving two or more men simultaneously and “particularly degrading and humiliating intimidation and violence”, one count of sexual assault without penetration, and mistreatment and privacy crimes relating to the publication of the mobile phone videos.
As well as doing prison time, the eight men convicted will have to compensate their victim with more than €100,000 (£86,400).
After the incident, the BH Mallorca Resort said it was cooperating fully with the authorities and offered its support to the unnamed holidaymaker.
